A panel of a federal appeals court on Friday threw out a plea agreement that would have allowed Khalid Sheikh Mohammed, accused of spearheading the 9/11 attacks, to plead guilty in exchange for escaping the federal death penalty.
The deal, negotiated over two years, would have given Mohammed and two co-defendants life without parole.
In August, Defense Secretary Lloyd Austin overrode the agreement and re-instated the death penalty charge.
